Article Published: 10/23/05 I was appalled that former Supreme Court Justice George Wuest stated that the South Dakota Judicial Accountability Amendment was "... one of the nuttiest things I have ever heard." Wuest forgets that all too frequently he and other judges have ignored civil rights and due process violations of citizens without being held accountable. This is because of judicial immunity. If anyone doubts these facts I will gladly furnish documented evidence of it.A knowledgeable citizen and voter must ask themselves why should any honest judge be afraid of being held accountable for ruling properly about the facts, the law, and within the Constitution? The only judges afraid of having to defend their conduct are those who practice misconduct and abuse their authority. You and your family's constitutional rights and right to proper interpretation of the law are far too precious to leave in the hands of someone who is not accountable because they can hide behind immunity. What is nutty is not holding judges accountable for violations of their oath and citizens' due process rights. The Judicial Accountability Amendment would cure these abuses of power in our courts and needs to be implemented into law.
